VERACRUZ, Mexico — A Mexican man and woman who had been charged with terrorism for allegedly setting off a panic by tweeting rumors about nonexistent drug cartel attacks were freed Wednesday after prosecutors dropped the charges.

Criticism of the terrorism case led the Veracruz state legislature to pass a law Tuesday creating the charge of disturbing the peace to cover the situation purportedly created by the pair.

Cracks are appearing in the case against the Twitter users in Mexico accused of terrorism for spreading rumors of an attack.

Local reports and claims suggest that the "panic" that spread over rumors of child abductions at school campuses started at least two hours before the online messages that could put a man and woman behind bars for 30 years.

The Veracruz government has not responded to the claims.

Mexico "Twitter terrorism" breaches civil rights: lawyer

MEXICO CITY (Reuters) - Mexico has breached an international human rights charter by bringing terror charges against two social media users who wrongly reported an armed attack on a local school, a lawyer for the accused said.

The man and the woman face the threat of as much as 30 years in prison because they posted messages online and via Twitter late last month, warning that gunmen had stormed a primary school in the eastern coastal state of Veracruz.

A former teacher turned radio commentator and a math tutor who lives with his mother sit in a prison in southern Mexico, facing possible 30-year sentences for terrorism and sabotage in what may be the most serious charges ever brought against anyone using a Twitter social network account.

Prosecutors say the defendants helped cause a chaos of car crashes and panic as parents in the Gulf Coast city of Veracruz rushed to save their children because of false reports that gunmen were attacking schools.

Gerardo Buganza, interior secretary for Veracruz state, compared the panic to that caused by Orson Welles' 1938 radio broadcast of "The War of the Worlds." But he said the fear roused by that account of a Martian invasion of New Jersey "was small compared to what happened here."

Two people have been arrested in Veracruz, Mexico, on charges of terrorism and sabotage, after being accused of posting via Twitter and Facebook. Investigations are ongoing and so far have been denied access to a fair trial. If found guilty they could face thirty years in prison.
On 26 August, the local journalist Maria Jesus Bravo Pagola (known as Maruchi) and Gilberto Martínez Vera teacher were arrested by police at their homes in the city of Veracruz, located on the east coast of Mexico. According to state officials, both had been tracked down and arrested after rumors of possible attacks by criminal groups local schools circulate through social networks on 25 August, which resulted in parents collect their children several schools closed temporarily. The state government responsible for the panic to the rapid circulation of false information and accused Mary of Jesus and Gilberto Martínez Bravo Vera circular history Facebok Twitter and were arrested and accused of terrorism and sabotage under the Criminal Code of Veracruz .
The two detainees were transferred to Xalapa, Veracruz state capital, where they were held incommunicado for more than 60 hours. In recent months there has been an increase in violence in Veracruz, as different cartels vying for control of the city. The uncertainty creates a climate of mistrust, in which rumors of social networking are part of the attempt by people to protect themselves and there is little reliable information.
Amnesty International is concerned that although the information that flows through Twitter and Facebook may not have been correct, the arrest and indictment of Bravo and Maria de Jesus Gilberto Martínez Vera on charges of terrorism and sabotage are unfair and violate their right to justice and freedom of expression. Amnesty International believes it is the responsibility of the authorities to disseminate accurate and reliable information on the measures being taken to protect the population.
ADDITIONAL INFORMATION
Since 2007, violence linked to organized crime has reached a magnitude of nearly 40, 000 murders. The administration of President Calderon has tried to fight the drug cartels by deploying thousands of federal police and more than 50, 000 troops and navy personnel in the areas most affected. Members of the police and other security forces and local authorities are often suspected of corruption and of being in collusion with criminal groups, creating a climate of impunity and insecurity for the population in affected areas.
Veracruz has seen how they have increased levels of violence each different cartels vying for control. Across the country the violence has resulted in civilian deaths that are not involved, as well as indiscriminate killing bystanders. The increase in attacks on journalists by criminal groups has undermined security coverage, and the authorities' failure to provide timely and reliable information has encouraged the use of social networking as a means of communication to alert people alleged attacks and threats to their communities.

The men could be charged as terrorists, as Veracruz state law defines terrorism as "any person using explosives, toxic substances, firearms, fire, flood or any other means to carry out attacks on persons, things or public services, in such a way that creates alarm, fear or terror in the public or any sector of it, so as to disturb the public peace or disparage the authority of the government or pressure it."

Veracruz is one of several states in eastern Mexico where the drug cartels are at war with each other; in that state, the Gulf and Zetas drug cartels are fighting for control.
